In Georgia, Notaries Public are commissioned by the Clerk of Superior Court in their county of residence for four-year terms. A Notary Public serves as an impartial witness in the execution of important documents. These official duties, known as notarizations or notarial acts, often play a critical role in legal and financial transactions.

Most significant legal documents require notarization. Generally, a Notary Public verifies the identity of the signer and witnesses or acknowledges the signing of documents. Certain exceptions may apply in special circumstances, such as disability or illiteracy. While we perform notarizations, we do not prepare or create legal documents, including real estate or divorce paperwork. Although notarization is not required for the Form I-9, Notaries may serve as authorized representatives for completion of the form. Because this is not an official notarial act, service fees differ from standard notarization fees.

The primary purpose of notarization is fraud prevention. A Notary Public ensures that signers are properly identified, understand the document they are signing, and are doing so willingly and without coercion. This process helps protect the legal rights of all parties involved.

For a document to be notarized, it must:

1) Contain text that commits the signer in some manner

2) Bear the original signature of the signer (photocopies cannot be notarized)

3) Include a notarial certificate, either on the document itself or attached

A Notary Public may refuse service if there is reason to believe the transaction is unlawful, deceptive, coerced, or if the signer appears unsure of the consequences of the document being executed. For additional information regarding Georgia notarial law, you may contact the Georgia Superior Court Clerks’ Cooperative Authority or visit their official website.

Additional document services such as printing, scanning, and copying are available on a limited basis. Fax services are not offered. Walk-in appointments are not available at this time; all services are provided by scheduled appointment only.
